These Terms and Conditions ("Terms") govern your use of the Biscuits Notary website (the "Site") and the services provided by Biscuits Enterprises LLC dba Biscuits Notary ("Biscuits Notary," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Site.

1. Use of Site

a. You must be at least 18 years old to use this Site. By using this Site and by agreeing to these Terms, you warrant and represent that you are at least 18 years of age.

b. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for your personal use only.

c. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission.

2. Privacy

a. Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy for information about how we collect, use, and disclose your personal information.

3. User Accounts

a. You may be required to create an account to access certain features of the Site. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

b. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

4. Notarial Services

a. Biscuits Notary offers remote online notarial services. By using these services, you agree to comply with all applicable laws and regulations governing notarial acts.

b. Biscuits Notary retains recordings and associated data of notarial acts for a period of 10 years, encrypted by services provided by Indentrust.com.

Conditions for Notarization:
The notary reserves the right to decline notarization under certain circumstances, including but not limited to the following:

1. Incomplete or Incorrect Documents:
   If the documents presented are incomplete, incorrect, or contain discrepancies that cannot be resolved at the time of the appointment.

2. Lack of Proper Identification:
   If the signer(s) fail to present valid, government-issued photo identification as required by law.

3. Inability to Establish Competence or Willingness:
   If the notary has reason to believe that the signer(s) are not of sound mind, are under duress, or are otherwise unwilling to sign the document(s).

4. Document Type:
   If the document is not one that can legally be notarized, or if it requires specific notarization types that cannot be performed.

5. Presence of All Parties:
   If all required parties or witnesses are not present at the time of notarization, where applicable.

6. Unsatisfactory Conditions:
   If the location or conditions where the notarization is to be performed are unsafe, unsuitable, or otherwise do not meet the necessary requirements for conducting a notarization.

7. Non-compliance with Notary Requirements:
   If the signer(s) fail to comply with any other legal requirements necessary for the notarization to proceed.

5. Intellectual Property

a. The Site and its original content, features, and functionality are owned by Biscuits Notary and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

b. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in these Terms), create derivative works based on, distribute, or otherwise exploit any of the Site's content.

6. Limitation of Liability

a. In no event shall Biscuits Notary, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Indemnification

a. You agree to indemnify and hold Biscuits Notary, its affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

8. Changes to Terms

a. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

9. Governing Law

a. These Terms shall be governed and construed in accordance with the laws of Tennessee USA, without regard to its conflict of law provisions.

11. Credit Card Information

a. When you provide your credit card information to make a purchase or payment through the Site, you agree that such information will be securely processed by our payment processor. We do not store your credit card information on our servers.

b. You agree to provide accurate and complete credit card information for all transactions conducted through the Site. You are solely responsible for any charges incurred using your credit card.

c. Biscuits Notary will not be liable for any loss or damage arising from your failure to provide accurate or complete credit card information or from any unauthorized access to or use of your credit card information.

12. Cancellation Policy

a. You may cancel your appointment with Biscuits Notary, but please note the following policy:

i. Cancellations made more than 4 hours prior to the scheduled appointment time will not incur any charges.

ii. Cancellations made between 2 and 4 hours prior to the scheduled appointment time will require a 50% payment of the total service fee.

iii. Cancellations made within 2 hours of the scheduled appointment time will require full payment of the total service fee.

b. To cancel your appointment, please contact us at least 2 hours in advance at Nick Laing @ 629-729-2202.

c. Failure to provide sufficient notice or failure to appear for a scheduled appointment may result in charges being applied to the credit card on file.

13. Overdrive Policy

a. For appointments located 25 miles or more from our office location, an additional $35 travel fee will be charged. This fee is applied to cover travel expenses incurred for appointments at distant locations.

14. No Show Policy

a. If you fail to appear for a scheduled appointment ("No Show"), your credit card will be charged in full for the total service fee, plus a $25 service fee.

15. Act of God Policy

a. In the event of extreme weather conditions or other circumstances deemed dangerous, Biscuits Notary reserves the right to cancel appointments without penalty to ensure the safety of our clients and staff.

16. Travel Fee Policy:
If our appointment is scheduled at your location and, for any reason, the notarization cannot be completed, a travel fee of $50 will still be required. This fee covers the time and expenses associated with traveling to your location, regardless of the outcome of the notarization process.
